New federal rules regarding e-discovery have recently gone into effect on December 1, 2006. �E-discovery� is a legal buzzword covering all kinds of electronic data contained in backup tapes, hard drives, e-mails, Word files, spreadsheets, Blackberry data, and much more.

The proposed Federal Rules of Civil Procedure, in particular Rules 16 and 26(f), require that both the parties and their counsel become intimately familiar with the data storage and retention procedures in place at a corporate entity before the first initial scheduling conference, or else risk being subjected to costly discovery expenses or even outright sanctions.

Furthermore, parties to litigation in Federal Court will now be responsible for producing a large amount of electronic data for the other side. As you can imagine meeting this new discovery requirement will require both legal and technical expertise, given the numerous forms that electronic data takes.

The best way to prepare yourself for these changes is to consult with your litigation counsel and with your information technology professionals preferably sooner than later. Establish a plan for handling e-discovery before the new federal rules go into effect, or you may risk violating them.

Some basic steps in planning for e-discovery should include developing litigation hold policies, as well as procedures for producing e-discovery with your counsel.

Also, your counsel must meet with your information technology officer or consultants before the first scheduling conference in a federal case. Your attorney will be asked to agree to a timeline for, and the scope of, e-discovery in that conference. Woe to you if your counsel does not know what technological architecture and resources you have in place! Such a misstep could lead to excessive e-discovery costs, to monetary sanctions, or to allowing a jury to consider a damaging adverse inference.

1. 12 million illegal immigrants did not appear overnight. Actions by Congress - or the lack of action - created the environment for illegal immigration to exist.

2. The main drive behind legal immigration is family reunification, a holdover from WWII. Is it time to give preference to nurses and computer engineers over brothers and sisters of U.S. Citizens? What we need is not what we get.

3. Actions by Congress always have unintended consequences. Congress put annual limits on the number of H-1 visas that could be given to temporary professional workers. Registered nurses were split off into H-1A and others were put into an H-1B category. The H-1A program ended in 1996, and now we have a nurse shortage just as the Baby Boomers need more health care.

4. At the time of the last amnesty, employer sanctions were imposed as a compromise. Let the last group of illegals get green cards in 5 years, but make it tough for the next group. As we have seen, sanctions don't work. Fake documents are cheap, and many small employers don't keep the paperwork anyway. But the fundamental question was never addressed: "Why should employers be forced to spend their time and money doing the U.S. Government's job of controlling immigration?"

5. A recent trend is a test of a system where employers can call a number to see if an applicant is eligible to work in the U.S. Do we really expect massive mistakes not to be made here? Who protects the legal immigrant when immigration authorities give the wrong answer?

6. All of this is leading to a place that politicians and bureaucrats have wanted to go for years but which has been resisted by the people - a national ID card. Internal passports. "Give me your papers." Security after 9/11. Citizens should not have to prove their identities unless involved in crime. Bet that this will be our next loss of privacy and personal liberty.

7. If the government cannot stop illegal immigration at the border, why are we forced to put up with all the hassles of airport security? Are they just trying to fool us in to believing they can do something? The 9/11 hijackers all came in with legal visas.

Congress is so divided on the subject of what to do about 12 million illegal aliens living in the U.S., working, attending school, and creating new U.S. citizen children.

Congress is as much a part of the problem as the solution.

Nevertheless, alcohol is still used more than tobacco or drugs. According to a 2005 study conducted by the National Institutes of Health (NIH), 75% of 12th graders had tried alcohol and 87% of underage college students had tried it. Unfortunately, approximately 5000 young people die every year from causes related to underage drinking: Though injury is the leading cause of death for people under 21, alcohol is a factor in many of these injuries.

As young people are still experiencing physical and organic development, alcohol has potentially harmful effects on brain development. The matters of fact, followed by the matter of law are two of the daily heated discussion of Cambodia's social havoc. Protracted disputes over land, political, economic and social issues, etc have become, I think, the daily images painted on the Cambodian public media. So how is this country going to solve these conflicts? What mechanisms to be used for the conflict-resolutions? What are the causes of these conflicts? The following statements tempt to answer to above questions. For an easier procedure and understanding, I would consign my argument and elucidation into Cambodian perspectives and context. I would rather say from the very beginning that my writing is totally opinioned-based; data, political and legal analysis are not involved at all.

Law Is Mostly Used in Handicapped Mechanism

From the very outset, I would begin by looking into Cambodia's incurring negative events published in the public press. Everyday, we see the social, political, economical drawbacks appeared on the public press, so the law-related persons or entities do analysis, basing on legal ground. As the result, problems are arisen the committers are illegal or lawless, messing public orders and legal measures must be taken to obstruct these conductivities from future occurrences. We see that this is the perspective that "law is a mechanism to create problem (for better tomorrow)". But law doesn't mean to be deployed in just one side like this. Law must be deployed in twofold; a mechanism to create problem(s) and to solve the problem(s).

However, is law totally deployed as a measure to solve the conflict? Most or maybe all of the Cambodian people and international opinions would say no to this question. As we can clearly see through the public press, conflicts haven't been fully resolve through legal path, since bribery, corruption, collusion, political relation, etc. These are some of the factors, that most of the Cambodian public and foreign analysts view that conflicts haven't totally been resolved though the legal path.

Legal path, I refer to here, must be "general" and "absolute". General: Cambodian law must equally apply to every Cambodian national. For instance: if law states, "everyone must drive 55kms per hour". This means that everyone; adults, government members, members of parliament, senators, private company staff, diplomat...etc must driver 55kms per hour and any breaching of this rule would result in bad consequence. Absolute: there would be no exception for anybody. If law states that this person must be killed, there is nothing can obstruct the law; though is person is the senior official, millionaire or philosopher. Absolutism also refers to that law has no choice, there is only one way out. For easier to understand, let me bring a practical example: in the market you have the choice between the products, whether you want to buy or not to buy the product, but law is different you have only one choice; follow it. Until the two of my imposed characteristics of law; general and absolute, are ubiquitously applied, then I believe that law in Cambodia is not used in just one way anymore.

Dim Legal Perspectives In Cambodian Context

Because it is not a mechanism to solve the conflict, we see that law has a very dim light in Cambodian state of affairs. Most of the Cambodian people and international opinions have very little or no confidence at all with Cambodian legal officials, systems and enforcement. This is, I think, the major problem that law is thought as not a good subject for future job prospect for a huge number of students. Because a huge number of students see law as "not money-oriented", Cambodia is losing a sector that creates employment diversity, specifically jobs related to law.

Since people don't really trust legal perspective in Cambodia, we see that lawyers are employed very little in the family, companies, factories and other state and business entities.

Conclusion

It is very hard, I believe, to touch the Cambodian legal ground and make my argument efficient in such a piece of paper. But since, I am not the professional ego-issue monitor and analyst, I would rather condense my expression to what are my daily encounters. And I still courageously claim that, Cambodian law is not adequately deployed; just a mechanism to create the conflict. I just want to remind that law must also be deployed as the mechanism to solve the conflict. The result of handicapped usage of law, as we can see, countless turbulences are perpetually stirring; land issues, violent rape, domestic violence, paramount traffic accidents, and increasingly legal downturn and economic downward spiral.

The most vital essence of law, I think, is "justice", but this justice would have more prospects to be gained, until law becomes day-to-day operation, and not just a piece of paper that any can buy or not to buy.

If you meet certain criteria as established by the jurisdiction in which you live you may be eligible to erase or hide your criminal background.

Different jurisdictions use different words to describe roughly the same legal remedy. That is, a mechanism by which you can erase, or at least tidy up, your criminal background. The words most often seen to describe this in state law are: �Expungement� �Expunction� �Sealing� and �Non-Disclosure.� I have placed these words in rank order according to how often I see them used.

The words �Expungement� and �Expunction� according to Black�s legal dictionary mean roughly the same thing: �To destroy; blot out; obliterate; erase; efface designedly; strike out wholly. The act of physically destroying information � including criminal records � in files, computers, or other depositories.�

Black�s legal dictionary provides that the �sealing� of criminal records on the other hand refers to: �statutes in some states that permit a persons criminal record to be sealed and thereafter such records cannot be examined except by court order or by designated officials. Such statutes commonly refer to juvenile offenders.�

�Non-disclosure� as is applied to criminal records refers to a court order directing that criminal records NOT be disclosed except by further court order.

While each of these words has a �dictionary� meaning, that does not necessarily mean that they carry that meaning in your jurisdiction. That is to say, different states may define the same words differently. This means that �expungement� in your state could mean the same as �Non-disclosure� in a bordering jurisdiction.

Here�s the lesson: if you want to know exactly what these words mean in a particular state you must look to the specific statutory definition of the word in that jurisdiction.

There may even be a problem with that, however. There is a possibility that the legislature of that jurisdiction did not define the word. In this event, the next step is to find case law (law as it relates to a particular fact pattern written by judges) defining it. Many times case law will define what the words mean in that particular state.

So why is all of this important?

Remedies (the legal way to clean up a criminal record), procedures and effects of those remedies will vary from jurisdiction to jurisdiction and the foundations of these differences are based on the definition used in a particular state. In other words, you don�t know what a remedy provides until you first know the definition of the remedy.

For example, some jurisdictions will with a valid expungement order deem the criminal arrest to have never happened . Others will use the expungement order to mean that the arrest will not be publicly disclosed but that other law enforcement officials can still find it and use it e.g. to show a prior conviction, etc..

Thus, don�t assume the meaning of the word or the ramifications of the remedy until you first research what they are in your jurisdiction. Armed with that knowledge you'll be better able to make an informed decision in dealing with your criminal record.

Passed by the U.S. House of Representatives on November 13, the bill, supported by the American Horse Council, increases the criminal and monetary penalties for crimes against animal owners and requires that restitution be made to owners who suffer particular economic losses.

The bill�s goal is to provide the Justice Department with the authority to apprehend, prosecute and convict individuals committing animal enterprise terror.

An animal enterprise, as defined by the bill, includes academic and commercial institutions that maintain or sell animals for profit, agriculture, education, research, testing, food and legal equine events such as horse shows and rodeos. The bill also protects zoos, aquariums, animal shelters, pet stores, breeders, circuses and furriers. The protection also extends to fairs that �advance agriculture arts and science,� according to the bill.

The bill states that it is a crime to �damage or interfere with a legitimate legal animal enterprise.�

The act defines the potential fines and imprisonment for such related crimes. For example, the guilty party can be fined and imprisoned for five years or less if he or she inflicts between $10,000-$100,000 in damages or if there is reasonable fear for serious human bodily injury or death.

The Types Of USA Visas To Reunite Families

Under the current immigration laws that regulate the flow of immigrants into the US, there are two categories of USA visas that are issued: the non-preference visa and the preference visa.

Those who are wanting to emigrate from their homelands and those who will benefit from either of these two types of USA visas will subsequently qualify to live and/or work in the United States.

The applications for them are subject to a strict annual quota of 675,000 only. There is a preference system in place for the issuing of these visas and there are four categories of preferences for family-sponsored immigration and five types of preferences for employment-sponsored immigration.

The annual cap on the number of family sponsored immigrants is 535,000. As well, there is a set minimum of 226,000, that must be issued within any given year. That leaves a total of 140,000 of them that are issued annually for the employment related category.

While these numbers are the current quota levels, the US federal government and the US Citizenship and Immigration Services department has made it clear that these numbers for the preference categories are subject to adjustment and change as needed.

The non-preference categories of USA visas are the following: Sons and daughters of US citizens who are unmarried. This type of visa is limited to a maximum of 23,000 to be issued in a year. This category also includes divorced adult daughters or sons of US citizens.

The adjudication of a son or daughter is different than the adjudication of a child, even though both are the offspring of a US citizen. For the purpose of US immigration, a child is considered to be an unmarried daughter or son who is under the age of twenty-one.

A child of a US citizen is allowed to enter the US without any consideration of the numerical quota for that type of visa. Therefore, the daughter or the son of the US citizen can be any age over 21, to qualify for a US permit application in this category.

Another category of preference in them is that of the spouse and the unmarried sons and daughters of legal and lawful US citizens or legal permanent resident aliens. This preference category does not take age into consideration, with regard to qualifying for this type of visa. There is a minimum of 114,000 visas of this type that are allotted for each year. This number may be augmented through the usage of any unused visas out of the first preference category.

Statistics have shown that approximately seventy-seven percent of them are provided for the spouses and for the children of permanent legal resident aliens in the US. This leaves the other twenty-three percent of them to be issued to the unmarried daughters and sons of US citizens or legal resident aliens.

A son or daughter of a US citizen who has been divorced is usually allowed to live within the US and also to work in the US, under the status of being an immigrant beneficiary who has been sponsored by a US citizen or by a permanent resident alien.

Yet another category of preference for the USA visas is that of the brother or the sister of US citizens. The yearly cap for this category is 65,000. However, this number can be increased if there are other available visas that were not issued from another category of family based visa preferences.

Conditional fee agreements are creating incentives for the legal profession for financial gain. Using the popular �no win no fee� to entice people is misleading and wrong. Many companies are only too each and too quick to let their clients sign the �Conditional fee agreements� without the clients truly understanding all the risks and liabilities they may be exposing themselves too.

There needs to be more emphasis on advising and explaining what the agreement really means. What the real financial risks are and what can be done to prevent these. A system of regulation should be introduced to protect the people and surely is the only way forward.

Positive outcomes can be the lessons learnt from compensation claims. Unfortunately sometimes it takes an accident for employers and the public to realise the dangers in the first place. Civil Partnerships

Civil Partnership Act 2004

The Civil Partnership Act 2004 came into force on the 5 December 2005 providing a long overdue legal recognition of same sex couples' rights. Same sex couples now finally have largely the same legal rights as that of heterosexual married couples. However, there does appear to be 2 areas where the legal rights of civil partners and married couples differ.

Dissolution
The grounds for dissolving a civil partnership are the same as those for dissolving a marriage with one exception - adultery is not a ground for dissolution in a civil partnership unlike in marriage cases.

Pre-Partnership Agreements
Pre-nuptial agreements have been available for many years but it would seem that only the most wealthily couples who intend to marry avail themselves of this agreement, and it there appears to be little encouragement from legal forums to use them.

Conversely, with the introduction of Civil Partnerships, much emphasis has been placed on entering into a Pre-Partnership Agreement. The Pre-Partnership agreement has been extant for many years now. Previously referred to as 'Cohabitation agreements' it was considered a useful document to have where couples - both same sex and heterosexual - decided to live together. More often than not however, people never knew of the existence of such a document, as is probably the case today. With the introduction of civil partnership rights, much emphasis has been placed on having such an agreement. The document should be entered into prior to registering the partnership, and is designed to deal with how the couple wish to deal with financial issues in the event that the partnership is dissolved.

The Law Society of England and Wales has argued in its literature that whilst Pre-Partnership Agreements - like pre-nuptial agreements - are not legally binding, with the courts usually deciding to split assets 50/50 on divorce pre-partnership agreements ought to be considered as the law will treat civil partnerships in the same manner as divorce.

Tax & Wills Implications

Civil partners will be treated the same as married couples for tax purposes. Thus, all the same inheritance tax exemptions available to married couples will also be available to civil partners. Such exemptions will include the Nil Rate Band allowance (currently ฃ275,000) and the 'spouse' exemption whereby all transfers between spouses are exempt from inheritance tax and will also be the case with civil partners. The other implication of entering into a Civil Partnership from a Wills perspective, is that any existing will shall be invalidated upon registering the partnership. The extant Will shall automatically be revoked, and a new Will should be drafted. If you wish to make a Will in expectation or contemplation of entering into a civil partnership - or marriage for that matter - specific clauses will need to be drafted into the Will to ensure that it remains valid after entering the partnership/marriage.

Thankfully the law relating to Civil Partnerships is on a very similar footing to that of marriage, thus matters are not too complicated. As with advice given to married couples, making a Will is important as you should not assume that your spouse/partner will inherit your share, and it may well be that specific clauses will need to be drafted into Wills for civil partners.

Company directors could be in for a shock this month when more parts of the Companies Act 2006 come into force, thus expanding the range of people that directors must answer to and making it easier for shareholders to sue them for alleged breaches of their duties.

The Companies Act 2006 - the longest single piece of legislation ever passed by Westminster - is aimed at bringing a ragtag of company law together in a single piece of legislation. But it also adds some significant new duties on directors. From the 1st October, the duties of company directors will be widened beyond their existing obligation to promote the success of their companies to also taking account of the interests of their employees, the environment and the community.

Perhaps more urgently, the parts of the Act being introduced this month will also make it simpler for shareholders to sue the directors of companies they own a stake in. Previously, individual shareholders only had the right to sue company directors in cases of fraud, but now will be able to bring claims for breach of duty, meaning that directors may find themselves facing many more legal claims than in the past. These so-called �derivative actions�, in which shareholders can sue individual board members on behalf of the company, will mean that any compensation awarded will be paid to the company directly from directors� own pockets, although many will be covered by insurance. Lawyers are certainly gearing up for a spike in litigation - a poll last month in trade magazine Legal Week found that 75% of business lawyers expect a rise in class actions as a result of the Companies Act.

The Companies Act will also introduce new laws on directors' conflict of interests; the use by directors of company property; remove the requirement for private companies to appoint a company secretary; and impose greater responsibility on companies to communicate with their shareholders. It will also amend takeover laws to make mergers between private companies easier, tighten up the rules on the appointment of auditors and change the requirements on new companies' memorandums and articles of association.

Without going into the merits of ability or legal rights and rendering unequal treatment to a person is known as discrimination. In the US, state and federal laws forbid discrimination in rates of payment, employment, promotion rights, opportunities in education, civil rights and facility usage on the basis of nationality, race, colour, creed, sex, age and sexual orientation. Protesting against discrimination or seeking enforcement of rights of equal treatment is provided in various state and federal laws.

Not all discrimination is illegal. There is legal discrimination too. When a person is given different treatment based on the membership of their class it is an illegal discrimination because being part of a race, national origin or age, colour, family status, or gender cannot be controlled or changed by an individual.

Whereas an individual can control his or her behaviour in respect of a credit record, being a law-abiding tenant, accumulating wealth or having a secure job. A discrimination based on the above is perfectly legal.

The law on discrimination is very complex to understand because there is always exceptions and variations of being a group, whereas the rules are applicable in general context. If a person falls sick due to excessive smoking, which leads to a disability, then that person cannot fight against disability discrimination. Similarly certain characteristic of a group can be changed - for example a change in family status or a change of religion.

It is very difficult to prove illegal discrimination. Treatment shown to one person should be proved as different from the general treatment given for the same cause

Many landlords come out with excuses for the special or not so special treatment to get away from illegal discrimination. If the new owner is of different color from the existing tenant and the landlord is showing payment history as cause for eviction, then it is very difficult to prove illegal discrimination even though the cause shown is different from the hidden cause for the eviction.

Similarly according to California's fair housing laws, a tenant cannot be discriminated simply because he or she is availing child support or public assistance.

A disabled person cannot be discriminated against by not providing ramps, handrails, or illuminated doorbells etc. This is a case of clear discrimination based on the disability and the law of the land is very much in favour of the disabled community. These provisions should be made available either by the landlord or if not already available, the tenant should be permitted to include these provisions at their own cost.

The Legal Interview Question: What Are They And How Do You Answer Them?

I�d describe a legal interview question as one that might appear a bit unusual but is actually acceptable. Depending on the specific job you are interviewing for, the industry you work in, and depending on the employment laws that apply in your country or region, the wording of such questions and the ability of the interviewer to ask these sorts of questions might differ.

Questions that you can typically be asked during interviews are certainly legal of course ie. questions related to your previous experience, skills, accomplishments.

But what if you are asked a question that you might not be sure how to answer but is actually quite legal and is one that you need to properly answer if you wish to get the job?

Here are some examples of subjects that I would classify as legal interview question material:

Your ability to legally work in the country

Depending on where you live, there might be some legalities regarding how an interviewer can actually word this question but in the cases I�ve seen, it is certainly a fair and legal interview question. The company wants to know if you are legally able to work in the country and if not, are they going to have to help get your work papers and if so, how much will it cost and how long will it take? If they need to hire someone in the next few weeks and your work visa will require 3 months to process, they may not wait around for you. In my experience, this is an important and legal interview question faced by people who have just moved to a new country to work or are planning on moving to a new country to work.

Questions about your educational achievements and/or relevant certifications or training

Asking about your education and/or certifications isn�t unusual of course but your future employer might actually ask to see proof of your degree or certification. I have seen some employers who will request a photocopy of educational achievements especially if the education is a specific requirement of the job and/or if they�ve been burned by people lying about their level of education in the past. If your educational achievements are from a foreign country, you may also be asked for proof.

Moral of the story?

If you are �a few credits short of a degree� then you don�t have a degree! Don�t state that you have a degree if you haven�t completed one. I have seen so many job candidates state in their resume that they have a degree but word it in such a way that makes me quickly realize they don�t actually have one. When I ask for clarification, they admit they are �a few credits short of a degree.�

If your degree is pending or if you are in the process of completing it, state the expected date of graduation so there is no risk of confusion as to your level of education at the time of applying for the job. Don�t get caught in a lie because when it�s found out, it will most likely ruin your chances at the job.

Your ability and propensity to travel

Some positions require a significant amount of travel and this is a typical reason why people burnout and quit jobs requiring their employers to hire a replacement. In other words, if travel is an important and significant part of the job, expect to field questions regarding your willingness to travel.

Be honest. If they tell that you travel is 75% of the job and you really only want to travel 25% or less, what is the point in saying that this level of travel is acceptable? I�ve seen people accept jobs where the high amount of travel tires them out quickly and causes them to quit.

Your ability to work overtime, shift work and/or weekends

Your work hours are certainly something that you want to get confirmed with an employer before you are hired without necessarily making it look like you are a clock-watcher and are trying to figure out exactly how many hours you�ll be in the office each day! Having said that, I have dealt with companies that do specify work hours that can be considered a little bit out of the ordinary, especially companies that work with divisions in other countries and/or time zones and might require you to work outside of the �typical� 9am-5pm work hours.

Your criminal record (if any).

This is certainly a very important question if you work for (or would like to work for) a company where security clearance is part and parcel of the position. Again, depending on where you live, there might be legalities regarding how the question can be worded but in my experience, this is a perfectly legal interview question.

Local laws might dictate what constitutes a legal interview question and which questions are off limits.

Some of these questions might be necessary depending on your industry and level of position.

If you are interviewing for a job in a different country, you will need to gain the legal ability to work in that country first so this is obviously a concern for a potential employer if gaining this status might take you months or more.

If you were interviewing for a position that involved security clearance, any criminal record would obviously be an important consideration for the hiring company.

Before you attend an interview, try to have a clear idea of any possible legal interview question that you might be asked given the job you are applying for, and given the industry you work in.

You have completed four years of undergraduate studies, survived three years of law school and now landed your first job as an associate in a mega law firm. Now, it�s time to put all your hard work into action. Although your college education has prepared you academically, it does not account for the practical day-to-day function of a law firm. In my twenty years of experience as a legal secretary, I have watched countless first-year associates struggle to assimilate into their new environments. It becomes painfully obvious that they have not done their homework prior to pursing a legal career and are now faced with the tough decision of whether this was the right career choice. At this point, such negative thought is irrelevant because you are committed to at least one year of service, and how you approach this challenge could determine the rest of your professional career. I have outlined five strategies guaranteed to help new associates have a successful first year.

First, build a relationship with your legal secretary. An experienced legal secretary understands the managerial administrative tasks of your practice. The knowledge that your secretary posses is priceless and will prove advantageous to your success. For example, if you are a litigation attorney, court filing procedures and formatting of documents is crucial in meeting deadlines because you don�t want to risk having your complaint rejected by the court, causing penalties and humiliation among your colleagues.

Second, learn to dictate effectively. The most frustrating thing for a transcriber is to receive a tape that is inaudible and has no clear instructions. Personal Injury Checklist - What to Do if You are Injured in an Accident

Here is a short checklist of what to do if you have had an injury in anyway. It is not intended to impart legal advice because each case is different and each case can pose its own legal issues. Regardless, you should consult a lawyer immediately to help protect your interests.

Report the accident to the Police, if the impact was significant. Your lawyer will then obtain the police report, if any.
Immediately obtain medical treatment if you are injured. Failure to obtain immediate medical treatment diminishes your claim that you suffered injuries as a result of the accident.
Take pictures of damages to any cars/property involved � before any repairs or improvements are made. Non-digital pictures, for example, from a disposable camera, are better than digital pictures because digital pictures are susceptible to later claims of alteration.
Take pictures of your injuries immediately. Pictures can more easily and accurately describe injuries.
Do NOT make a statement to any insurance representative without consulting a lawyer. Those statements may be used against you in your attempt to obtain full compensation for your injuries.
Keep a list of all doctors, hospitals and treatment centers you visit.

Firing Someone Without Resentment

Firing, sacking, letting go or terminating people is unpleasant. There are ways to minimise resentment, but why bother? Because most legal action and unpleasantness stems from dissatisfaction/resentment about the way things were handled - about how rather than what happened. Dismissal can be unfair because of the reason, or the way it was done, so you need to be extremely careful. In the law regarding employer-employee relationships, fairness is key. You must be fair, and be seen to be fair. But fairness, like beauty, is in the eye of the beholder - after being terminated, very few people have clear vision!

Prepare a disciplinary process/policy given to all, with a sequence of verbal then written warnings ending with dismissal. Ensure processes allow for discipline/termination on grounds of both performance (capability) and attitude (conduct). Specify your right to instantly dismiss someone (summary dismissal) for gross misconduct, and give guidance on what would constitute this.

Have hard evidence to back up all decisions. Documentation of poor conduct and/or capability is essential. You have to follow your own process to avoid legal unfairness. Negative appraisals/reviews make good evidence.

Never take decisions lightly - weak performance can sometimes be improved by skilled intervention/support. Termination is traumatic/demotivating for surviving staff, even when they understand why.

Avoid surprises by giving every opportunity for improvement before opting to terminate. This reduces grounds for legal action. Plus, survivors feel less threatened if they see you are fair. Employees who have been aware for some time there is a problem are usually less traumatised, and may already be looking elsewhere. Always avoid firing someone who has no idea its a possibility, except for summary dismissal.

Get legal advice if you have any questions. Balance ฃ200-500 for advice against ฃ50,000 max unfair dismissal compensation! Phone lawyers and ask for advice on dismissal - sometimes possible over the phone for a fee. Remember, sexual/racial discrimination compensation is unlimited, so always take legal advice if this might be alleged, whether or not it happened.

Plan your speech exactly and write out a script. It ensures you say everything necessary, and helps if you get stuck. There can be temptation to offer sympathetic/reassuring words to sweeten the message. Unfortunately, kindness here can cause confusion and lead to legal action. Have a witness present - never fire one-to-one.

Stay calm - never act in anger. Even summary dismissal can be done after an hour to prepare and calm down. If employees lash out verbally/physically, don't respond. Get it right, and this is the last time you will deal with them - they will no longer be your problem.

Be humane - treat people sympathetically if possible - without conveying anything positive about conduct/capability. They are losing their job and income. They are frightened, angry, upset, devastated - and you have to deal with it. Sympathise with their predicament without commenting on the cause. Being calm and softly spoken can negate trauma. It also decreases unpleasantness - it's harder to abuse someone who is being nice to you.

Recommended action: ท Have a policy, publicised to all staff, and signed for receipt by all.

ท Have the policy legally checked by an expert.

ท Always prepare.

ท Remember the way you terminate someone can be legally unfair, even if the grounds are perfect.

With the recent introduction of the iPhone, many iPhone peer to peer networks have come about. The question lingering in many consumers minds is... are these iPhone download services legal? In the following paragraphs, we'll discuss what is legal and what isn't, as well as why.

Ok, so getting to the initial point of the article, are these iPhone download services legal? In short, there is a lot of recent precedence that says they're not illegal. So now you're saying, "but I thought file sharing was a huge no-no?"

Well that depends on a couple of things, how you use the technology, as well as the topology of the file sharing network. Liabilities fall on different parties in each case. You may have noticed the hype, the buzz, the hoopla, of peer to peer filing sharing has calmed down recently. Why?

A decentralized file sharing network is a peer to peer network not unlike a centralized network, with one KEY difference. As the name suggests, there is no central server, which means, if the software developer turns of his or her computer, the network can continue to run seamlessly, because the software does not rely on the centralized server to operate.

A trial separation may allow the spouse who wants the divorce to experience some of the feelings of being separated without making a final decision to divorce. The main advantage of a trial separation, of course, is that it's easily reversible. You can try it for a while, go through counseling, and then reconcile, or you can try separation for a while, decide you like it - and then proceed with divorce.

There are two ways you and your spouse can separate: either with an informal separation or by a formal legal separation.

An informal separation is basically whatever the two of you agree it to be. Typically, one of you stays in the home you had previously shared, and the other moves into some other quarters. At this stage you normally wouldn't make any formal property division, but you would agree, informally, on some kind of working arrangement about possession of things like cars, the bank accounts, the credit cards, and the stereo.

A formal legal separation is more permanent, more complicated, and more expensive. It's also much less common. It's nearly as expensive as a divorce - sometimes more so, because it's less common - so you may have to pay your lawyer to figure out how to do everything. And often people who get a formal legal separation wind up having to go through all the pain, time, and expense again later to get an actual divorce.

So why, I hear you ask, would anyone go through a formal legal separation? Maybe because some states require that a couple seeking a divorce have been separated for some period of time. Also, some couples need to remain legally married, perhaps so one can continue to be insured for medical or other purposes by the other's company. Formal legal separation makes this possible.

Occasionally, there is no question that the couple is moving toward divorce, but know it will take some time to work everything out. If their incomes are substantially different, it may be worth agreeing on a written separation agreement; that way the person paying any alimony can deduct it on his or her tax return. The paying spouse might be able to pay the receiving spouse more than enough to pay the tax on the alimony, and still come out ahead. Sometimes one of the spouses has a religious objection to divorce. A formal separation will allow the spouses to remain officially married even as they live separate lives.

Beyond that, there may not be much of a reason to go through the time, pain, and expense of a formal legal separation. Better perhaps to agree to reach a working arrangement for an informal separation. You can then follow it up directly with either reconciliation or divorce.

So, can separation save a marriage - that is the question. Some people strenuously resist separation, thus adding even more stress into an already tense marriage. Perhaps separation may be the best option for some marriages, despite the looming shadow of divorce, as living together is obviously is not working. However, can you make it work from a distance? A trial separation will go a long way in helping you decide the answer.

Why? Because couples who separate tend to find that without the constant daily conflict and bickering the lack of proximity to their spouse provides time to think, and solve problems. Marital problems are often hard to resolve as they often get stalled by egos, fear and stubbornness. Resolution can flourish as long as at least one partner is willing to keep trying; if the urge to always be right and not back down remains then it probably means that the separation will end in divorce.

It is therefore strongly recommended that you at least give trial separation a try. If only for the sake of trying to save your marriage.

Identity Theft Workers Arrested

Over 1300 workers have been detained and arrested by police in the US over identity crime. Charges have been brought against 150 illegal immigrants who have been accused of stealing the identities of US citizens. The purpose of this crime was to gain legal employment. Other defendants will face the charge of illegal re-entry document fraud, social security fraud and identity theft. Additional charges are being brought against almost 100 other defendants.

The identification of these illegal criminals was the result of an organised attack. Operation Wagon Train was a joint effort by related departments in the US. The arrests and undercover operation shows that the United States takes identity theft very seriously. These illegal immigrants were trying to get legal jobs by illegal means. The message being sent out by the authorities is that nobody can gain lawful employment with a stolen identity. The stealing of these identities include the improper use of stolen Social Security numbers and other documents in order to get a job.

Many of the victims of this identity theft had already alerted the authorities to the nature of their stolen personal data. Some of the victims first knew about their stolen identity when the Internal Revenue Service began demanding taxes for unreported income. This income had, of course, come about by the illegal employment of the aliens who had stolen the original identity.

Government officials are increasing their efforts in order to support the crime of identity theft. Last year (2006) almost twice the number of prosecutions took place compared to the year before.

Your Selling-Renting and the Tenant is Denying Access

How many times have we found ourselves trying to sell a building and we are confronted with a tenant who does not cooperate.

The tenant does not want to let you in. You know you have the right to show but want to be sure that you do this exactly according to procedure. The tenant is already unhappy about having to move and you don't want to be be sued and besides your priority is to show it not have a legal fight.

The best approach in any potential dispute is to talk it out. There may be circumstances in your tenants life that you could accommodate and avoid a fight. Try to sit down and find out why or what you can do in a compromise that would allow you to show and accommodate the tenant. Going to war is always the last thing you do. Good communications (in writing) and some understanding as to how disruptive to the tenants life along with a working knowledge of proper procedure should minimize friction.

What is Proper Procedure?

OK, you've tried to be nice and still you are dealing with a rude and uncooperative tenant. Here is where you must proceed according to law so that you avoid a legal argument. Now you have to assume the tenant would love you be slip up. You should talk to your real estate attorney, property manager or apartment association and follow the rules exactly and always document! All conversation should be in writing and if its really heating up use certified mail, that will put the tenant on notice that you are serious and ready to apply the law.

First you must give proper notice.
1. Do this in writing and give the approimate time, date and reason for your visit.
2. Hand deliver at least 24 hours before you intend to show the unit.
3. Your showings should be during business hours, whenever possible. This will leave the tenant little reason to complain its too late.
4. If you intend to mail, give them one week's notice and send it certified if you have a problem tenant. You should check with local law to see how much notice you need when notifying by mail.

Now you are within your rights to enter. However, never force your way in and don't argue if they still wont allow entry. The law is on your side so don't do anything silly like changing locks or getting angry. Try one more time to see if you can make suitable arrangements such as best times for entry or how many showings per week is reasonable. Its possible to negotiate a reasonable schedule with the tenant to avoid fiction. If its still a problem send a certified letter indicating that the law allows you to show and that you have may take legal action. You can terminate a lease if a tenant does not allow a lawful entry. The paralegal profession began back in the 60's and 70's. Attorneys began hiring assistants to help them with general duties, case investigation and paper work. This trend was noticed by the American Bar Association and it resulted in the formation of the Standing Committee on Legal Assistance which was established to setup standards in the paralegal / attorney relationship. It included duties associated with a paralegal and employment guidelines. Today, the committee consists of both professional paralegals and lawyers.

The American Bar Association offers a certification training program to schools that offer paralegal certification and training. This helps to establish educational and training standards throughout the industry which helps to ensure training uniformity.

In addition to the American Bar Association, there are a number of national organizations for paralegals that have also contributed to the refining of the paralegal / legal assistant profession.

Two of these professional organizations are the National Federation of Paralegal Associations (NFPA) and the National Association of Legal Assistants (NALA). Together they represent about 30,000 paralegals in the United States. While these organizations are competitors, they have come together to help shape and serve the paralegal field. NALA prefers to call individuals in the profession legal assistants while NFPA prefers to call them paralegals.

Another organization, which consists of paralegal educational programs and teachers, is called The American Association for Paralegal Education or AAfPE. Consistent paralegal educational standards are one of their key points of interest.

Another professional organization for paralegals, which primarily serves individuals, was created in 2003 and is called The American Alliance of Paralegals. It quickly began setting standards in the paralegal field and paralegals are required to meet particular work experience and / or educational guidelines in order to be a voting member. It was also the first national organization for paralegals to become involved in setting minimum educational guidelines and standards.

You may want to check with other paralegals in your area to see what they have to say about the professional memberships available in any of these organizations in your area. You may also want to inquire about other benefits of becoming a member and what type of professional development training each organization offers.

Well if you have just bought a Zune Player I will try to explain here what you can and can't play. Your own cd's can easily be downloaded to your Zune Player using the software that it came with, so they are not a problem.

Depending on where you live and the local laws, these are questions that are not considered to be legal interview questions but not actually be illegal to ask. An example of an unethical question would be one that asks you to divulge secret or confidential information about your current employer.

This might be a legal interview question but it's one that simply shouldn't be asked.

Another example of an unethical question would be one that asks you to do something that would benefit the company you are interviewing with and in exchange for doing it, would result in you getting the job. I�ve actually heard of companies who use a recruiter to find staff but then tell the job candidate that they will hire them under the table by cutting the recruiter out of the deal in order to not have to pay the recruiter!

Would you want to work for a company that treats people like this?

Probably not.

Another example of an unethical question would be one that isn�t actually unethical to ask but describes an unethical situation that you might face in your career and asks how you�d respond to the situation.

For example, I�ve heard the following question asked in an interview and the goal of asking the question was to gauge how the interviewee dealt with a hypothetical unethical dilemma that was posed to them:

Imagine that you have a chance to increase sales in your company by a significant amount of money by securing a very valuable contract that is worth $2 million. In order to gain this $2 million contract through, the person you are negotiating with has suggested that an under the table (ie. illegal or unethical) payment needs to be paid.

How would you respond?

In other words, would you accept the terms and make an under the table payment or would you walk away and refuse to make the payment but lose out on the $2 million contract in the process, perhaps to a major competitor?

A third way to handle the problem is probably the most effective and correct way to answer the question: keep negotiating until everything is above the table!

In other words, negotiate until everything is above-board and legal.

True, this would be an ideal result but remember this is just a hypothetical question and the interviewer would most likely be assessing your credibility and ethics to see how you deal with unscrupulous people.

The last thing a company wants to do is hire someone who does things �the wrong way!�

Educationally, China is forging ahead as partnerships and exchanges with foreign universities have helped create new research opportunities for its students." It goes on to say that half of China's exports are produced by enterprises that have foreign investors, and that the country has the largest foreign exchange reserves in the world.

This all bodes well for those who choose to study China law. Competing in such a vibrant, growing marketplace requires knowledge of both the Chinese legal system and the ways in which it changes in response to its changing economic landscape.

For years now, growing revenues from poker play at racetracks have been adding millions to Florida's tax coffers. The surging popularity of Texas Hold 'em and tournament poker has added even more fuel to the growth of Florida tax earnings, until now.

Recently, some racetracks decided to up the ante and challenge legal limits on amounts wagered in poker play. Initially, state courts didn't object to the challenge, allowing the Florida state Division of Pari-Mutuel Wagering to increase betting limits at authorized sites. When no-limit wagering at poker tournaments made its debut, however, officials decided to step in and cease all tournament poker activity indefinitely.

Though cash games (mostly low limit) can still be played at the racetracks, some sites, such as Dania Jai-Alai and Melbourne Greyhound Park, have already started to see a drop in patronage. Other card rooms, particularly in southern Florida, reported no significant changes thus far as a consequence of the legal ruling.

One of the most important decisions you will make when starting your cleaning business is deciding which type of legal structure is right for your business. The type of entity you choose will determine the amount of taxes you pay and guide you in the amount of paperwork you will have to deal with. It will also determine how much personal liability you have in the business, and can be a factor in raising money or borrowing money for your new business.

It is best to spend the time in the beginning to make sure that the entity you choose is the one most suitable for your particular circumstances. You can get advice on choosing your legal entity from the local small business administration, your accountant, and your attorney.

The different types of legal entities are:

*Sole Proprietor. This is the easiest type of business to form and is one of the most common for small businesses. You have complete control over your business and do not have to report to anyone. The drawback to a sole proprietorship is that the owner is personally liable for all financial obligations of the business. This means that if your business is sued you can be held personally responsible. Another drawback is that you are responsible for the entire sum of FICA taxes due. Normally the employer is responsible to match the employee's share, but when you are a sole proprietor, you must pay the entire 15%.

*Partnership. This type of business involves two or more people who agree to share in the profits and the losses of a business. The profits or losses are passed on to each partner and it is reported on their respective tax returns. Like a sole proprietorship, partners are responsible for the financial obligations of the business.

*Corporation. This is a legal entity in itself that is created to conduct business. The corporation is separate from the individuals that form the business and handle the responsibilities of the organization. Just like a person, the corporation can be taxed and it is also held legally responsible for its actions. A key benefit of a corporation is that the owner avoids the personal liability that occurs with a sole proprietorship or partnership form of business.

*C Corporations are typically large companies and are publicly held. If a C Corporation pays out dividends, then the profits are double taxed. The C Corporation must file a return on its own behalf and pays taxes on its profits before dividends are paid to its shareholders. The shareholders must then claim the dividends as income, which are taxed again.

*S Corporations elect a special tax status with the IRS and, therefore, do not face double taxation. The corporation is not treated as a separate entity; the profits are passed on to shareholders just as if the business was a partnership or sole proprietorship. The corporation itself does not pay taxes. However, there are strict requirements that an S Corporation must follow. Each stockholder of the S Corporation must be a US citizen and there is a limit to the number of stockholders an S Corporation can have. S Corporations can be appropriate for small business owners who want the legal protection of a corporation, but want the tax benefits of a partnership or a sole proprietorship.

*Limited Liability Corporation. This is a hybrid type of partnership. It allows owners to take advantage of the benefits of a corporation and a partnership form of business. Like a partnership, profits and/or losses are passed through to owners and like a corporation, owners are shielded from personal liability.

How do you know what business structure will work for your cleaning business? There are several factors to take into consideration when determining your business structure.

1. Legal liability. With a sole proprietorship or partnership you can be held personal responsible for the business, which means your personal assets can be taken if the business is sued.

2. Taxes. There can be a big cost savings in choosing one type of business structure over another. C-Corporations are "double taxed". The business profits are taxed and the money that is passed on to you as the owner is taxed again.

3. Management and flexibility. Do you want to have total control over the business? In a partnership or corporation there are agreements and bi-laws that you have to abide by.

4. Cost of formation and administration. Sole proprietorships are the easiest type of business to set up and maintain. There are very few legal forms or tax requirements other than just general good recordkeeping. A partnership needs to have a partnership agreement drawn up ahead of time. Both corporations and limited liability corporations need to have legal documents prepared before the business begins operation.

5. Future needs. Where do you anticipate the business being in 3 years or 5 years? If something happens to the owner, what happens to the business?

Your cleaning business can be successful with hard work and dedication. Choosing the appropriate business structure can make your task as a business owner much easier if you research your options before signing up your first client. iPod/iTunes: Under Attack from Hackers

Apple's iTunes/iPod is a closed business model, built on two essential premises. One is that songs bought from iTunes will only play on iPod players. The second premise is that songs purchased from other music download sites will not play on iPods.

Now Apple's business model is under attack - by 26-year-old hacker Jon Johansen. Johansen, of Norway, has decoded iPod's Digital Rights Management (DRM) encryption, known as FairPlay, according to reputable sources.

Johansen is making his hack available - for a licensing fee - to businesses seeking to sell hardware competing with iPod, and download sites competing with iTunes.

Note that Johansen's hack does not remove DRM from downloaded songs. It actually adds DRM, to trick iPods into thinking that a given song has been purchased via iTunes.

If this hack takes off, will the closed business model fall apart?

Hardly. Johansen's decision to market his hack through licensing agreements means that your average teen music-lover is not suddenly going to find his music collection iPod-compatible. Instead, she will have more choices of legal music sites, to download songs that will be iPod-playable.

The effect of this may be to lower the industry-standard pricetag of $.99 per song. Apple could face real competition from other sites that can now sell legal music to load into those insatiable iPod hard drives.
